By accessing or using BarterWith, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use our platform.

2. Eligibility

To use BarterWith, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

3. User Accounts

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update your information as necessary.

One Account Per Person

You may only create one account. Multiple accounts may be suspended or terminated.

4. Platform Use

Permitted Use

You may use BarterWith to:

• List goods, services, or skills you want to trade
• Browse and search other users' listings
• Communicate with other users to arrange trades
• Complete trades with other users

Prohibited Activities

You may NOT:

• Post false, misleading, or fraudulent listings
• List illegal items, services, or content
• Harass, threaten, or abuse other users
• Use the platform for commercial purposes unrelated to bartering
• Attempt to gain unauthorized access to our systems
• Use bots, scrapers, or automated tools without permission
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Spam or send unsolicited communications

5. Listings and Content

Your Responsibility

You are solely responsible for the content of your listings, including descriptions, photos, and communications. You represent that you have the right to offer the items or services you list.

Prohibited Items

You may not list:

• Illegal goods or services
• Stolen property
• Counterfeit items
• Weapons, drugs, or controlled substances
• Adult content or services
• Items that violate intellectual property rights
• Live animals (unless local laws permit and proper care is ensured)

Content License

By posting content on BarterWith, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting our platform.

6. Trades and Transactions

We Are a Platform, Not a Party to Trades

BarterWith provides a platform for users to connect and arrange trades. We are not a party to any trades between users. We do not guarantee the quality, safety, or legality of items or services traded.

User Responsibility

You are responsible for:

• Evaluating items, services, and trading partners
• Conducting trades safely and legally
• Meeting in safe, public locations
• Verifying the condition and authenticity of items
• Complying with all applicable laws and tax obligations

Disputes

Disputes between users must be resolved directly between the parties involved. We may provide information to assist in dispute resolution but are not obligated to do so.

7. Fees

BarterWith is currently free to use. We reserve the right to introduce fees for certain features in the future. If we do, we will provide advance notice and allow you to opt out.

8. Intellectual Property

All content on BarterWith, including our logo, design, text, graphics, and software, is owned by BarterWith or our licensors and is protected by copyright and trademark laws. You may not use our intellectual property without permission.

9. Termination

By You

You may delete your account at any time through your account settings or by contacting us.

By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when possible.

10. Disclaimers

BarterWith is provided "as is" without warranties of any kind. We do not guarantee that:

• The platform will be uninterrupted or error-free
• Listings are accurate or current
• Users are who they claim to be
• Trades will be completed successfully

Use at your own risk. We strongly recommend meeting in safe, public locations and using caution when trading with strangers.

11. Limitation of Liability

To the maximum extent permitted by law, BarterWith and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to:

• Failed or fraudulent trades
• Lost profits or business opportunities
• Data loss
• Personal injury or property damage

Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless BarterWith from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or listings

13. Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you may bring claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by email or through a notice on our platform. Your continued use after changes constitutes acceptance of the updated Terms.

15. General Provisions

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and BarterWith.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.
